Welcome to Angelisque! These Terms of Service (“Terms”) govern your use of the Angelisque website located at [www.angelisque.store] (the “Site”) and the purchase of products (apparel and home accessories) offered by Angelisque (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.   

These Terms constitute a legally binding agreement between you (“user,” “you,” or “your”) and Angelisque, made in compliance with the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Consumer Protection Act, 2019, including the Consumer Protection (E-commerce) Rules, 2020.   

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement under Indian law to use this Site and place orders.

2. Account Registration

You may need to register an account to access certain features. You agree to provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately of any unauthorized use.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Site. Prohibited behavior includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the Site.

4. Product Information and Pricing

• We strive to display accurate product descriptions, images, and prices on the Site. However, we do not warrant that product descriptions, colours, information, or other content are accurate, complete, reliable, current, or error-free.
  
   
• Prices for our products are subject to change without notice. All prices are listed in Indian Rupees (INR).
• GST: As Angelisque is currently not registered under the Goods and Services Tax (GST) regime and does not possess a GSTIN, the prices displayed are exclusive of GST. This may change in the future upon registration, and prices will be adjusted accordingly and clearly indicated.
• We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice (including after you have submitted your order). 
  
   

   

5. Orders and Payment

• Placing an item in your cart does not reserve it. An order is confirmed only after the checkout process is completed and payment is successfully processed.
• We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available, inaccuracies in product or pricing information, or problems identified by our fraud avoidance department. 
  
   
• Payment must be made through the available payment methods on our Site, primarily processed via Razorpay. By providing payment information, you represent and warrant that you are authorized to use the designated payment method. 
  
  
   

6. Shipping

All shipping will be handled as per our Shipping Policy, which is incorporated into these Terms by reference. Please review our Shipping Policy for details on processing times, costs, delivery estimates, and restrictions. Risk of loss and title for items purchased pass to you upon our delivery to the carrier.

8. Intellectual Property

All content included on the Site, such as text, graphics, logos, images, audio clips, video, data, music, software, and other material (collectively “Content”) is owned by Angelisque or its content suppliers and protected by Indian and international copyright laws. You may not systematically extract or re-utilise parts of the Content without our express written consent.  

9. Limitation of Liability

• To the fullest extent permitted by applicable Indian law, Angelisque (including its owners, employees, agents – noting its current unregistered status) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Site; (b) any conduct or content of any third party on the Site; (c) any content obtained from the Site; or (d) unauthorized access, use, or alteration of your transmissions or content.  
  
   

   

   
• Our total liability to you for any claim arising out of or relating to these Terms or the Site shall not exceed the amount paid by you for the product giving rise to the claim.  
  
  
   

10. Indemnification

You agree to defend, indemnify, and hold harmless Angelisque and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.  

11. Governing Law and Dispute Resolution

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India. Parties agree to attempt to resolve any dispute amicably before initiating court proceedings.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of material changes by updating the “Effective Date” at the top of these Terms. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.  

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, severed from these Terms, and the remaining provisions shall continue in full force and effect.   

15. Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, and Returns and Refunds Policy, constitute the entire agreement between you and Angelisque regarding your use of the Site and supersede all prior agreements and understandings.
